General Terms

  1. Application of Terms: These terms and conditions ("Terms") apply to all services provided by Witso Art Company Limited ("Witso Art", "we", "us", or "our") to you, the customer ("you" or "your"). By using our services, you agree to be bound by these Terms.

  2. Services: The services offered by Witso Art are as described on our website at Services and Subscription. All pricing and service details are subject to change without notice, and official quotations provided by Witso Art will be the final agreement for any products or services.

  3. Intellectual Property: All intellectual property rights in the services provided by Witso Art, including but not limited to copyrights, trademarks, and patents, are owned by Witso Art or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the services in accordance with these Terms.

  4. Confidentiality: You and Witso Art agree to maintain the confidentiality of any confidential information shared between the parties during the course of the services.

Subscription Services

  1. Subscription Period: The minimum subscription period for all services is as specified on the Subscription page. Subscriptions will automatically renew at the end of each subscription period unless terminated in accordance with these Terms.

  2. Payment: All subscription fees must be paid in advance. Witso Art reserves the right to suspend or terminate the services if payment is not received on time.

  3. Termination: You may terminate your subscription at the end of the minimum subscription period by providing written notice to Witso Art at least 30 days prior to the end of the subscription period. Witso Art may terminate the services at any time for any reason by providing you with 30 days' written notice.

  4. Refunds: No refunds will be provided for any unused portion of a subscription period.

Limitation of Liability

  1. Limitation of Liability: Witso Art's total liability to you for any claims related to the services, whether in contract, tort, or otherwise, shall not exceed the total amount paid by you for the services in the 12-month period preceding the claim.

  2. Disclaimer of Warranties: Witso Art makes no warranties, express or implied, regarding the services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

  3. Exclusion of Consequential Damages: Witso Art shall not be liable for any indirect, special, incidental, or consequential damages arising out of or related to the services, even if Witso Art has been advised of the possibility of such damages.

Miscellaneous

  1. Governing Law: These Terms shall be governed by the laws of Hong Kong, and any disputes shall be resolved in the courts of Hong Kong.

  2. Entire Agreement: These Terms, together with any official quotations provided by Witso Art, constitute the entire agreement between you and Witso Art regarding the services.

  3. Modifications: Witso Art reserves the right to modify these Terms at any time, and will provide you with notice of any changes.

  4. Severability: If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
